01Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”) and Cool Bionic Limited (“Cool Bionic”, “we”, “us”), a company incorporated in Hong Kong, governing your access to and use of our website at coolbionic.com and any purchase of our products or services.

By accessing our website, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Shipping Policy. If you do not agree, please do not use our website or purchase our products.

Important

Our products include ice baths, cold plunge equipment, and related accessories. These carry health and safety risks. By purchasing and using our products, you acknowledge the health warnings and safety disclaimers in Section 11.

02Eligibility

To use our website and purchase our products, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher).
  • Have the legal capacity to enter into a binding contract.
  • Reside in or have a delivery address in one of our supported markets: Hong Kong, Taiwan, Singapore, Malaysia, Thailand, Japan, Canada, Australia, New Zealand, or Indonesia.

If you’re purchasing on behalf of a business (B2B), you represent that you have the authority to bind that entity to these Terms.

03Products & Services

Product descriptions

We make every effort to display products accurately — descriptions, images, and specifications. However, we don’t warrant that descriptions, images, colours, or content are completely accurate, error-free, or current. Slight variations may occur due to photography, screen settings, or manufacturing.

Product availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify specifications at any time without prior notice. If a product you ordered is unavailable, we’ll notify you and offer a full refund or alternative.

Subscriptions

Certain products or services may be offered on subscription. Subscription terms, billing cycles, and cancellation will be clearly communicated at purchase. You may cancel at any time through your account settings — cancellation takes effect at the end of the current billing period.

04Orders & Payment

Placing orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including availability, suspected fraud, or pricing errors. An order confirmation email does not constitute acceptance; acceptance occurs when we dispatch the product.

Pricing

All prices are in the currency indicated and include applicable taxes and duties for your region (Delivered Duty Paid basis). In the event of a pricing error, we reserve the right to cancel the order and issue a full refund. We’ll notify you before processing any order affected by a pricing error.

Duties and taxes

The price you pay at checkout includes all applicable customs duties, import taxes, and fees for your destination. You will not be required to pay additional charges upon delivery under normal circumstances.

Exception

In the rare event tariffs, duties, or taxes are increased by government authorities after your order has been placed and paid, you may be responsible for any unexpected difference at importation. We’ll notify you in advance where possible, and you may cancel for a full refund if the additional costs are unacceptable.

Payment methods

We accept the following through our secure payment processor, Stripe:

  • Major credit and debit cards (Visa, Mastercard, American Express).
  • Local and regional payment methods available through Stripe in your market.

All payments are processed in a PCI DSS Level 1 compliant environment. We do not store full card details on our servers.

Currency

Prices may be displayed in your local currency where available. If your payment currency differs from the displayed price, your bank or card issuer may apply a currency conversion fee beyond our control.

05Shipping & Delivery

Refer to our Shipping Policy for detailed information. Key provisions:

  • Estimated delivery times vary by destination (3–20 business days depending on location).
  • We use third-party logistics providers and local delivery services.
  • Risk of loss transfers to you upon delivery to the carrier, unless otherwise required by your local consumer protection laws.
  • Shipping costs (if any) are calculated and displayed at checkout before you complete your purchase.

06Returns & Refunds

7-day refund policy

We offer a 7-day refund policy from the date of delivery. If you’re not satisfied for any reason, you may request a full refund within 7 calendar days of receiving your product.

Refund conditions

  • Full refund. You’re entitled to a full refund of the purchase price, including original shipping cost.
  • Return shipping. We cover return shipping — prepaid label or reimbursement of reasonable costs.
  • Product condition. Products may be returned opened or used, provided they aren’t damaged beyond normal trial use. Return with all original accessories, packaging, and documentation.
  • Exclusions. Refunds are not available for wilfully damaged, substantially modified, or products missing essential components.

How to request a refund

  • Contact support@coolbionic.com within 7 days of delivery.
  • Provide your order number and reason for return.
  • We’ll confirm and provide shipping instructions within 2 business days.
  • Once we receive and inspect the returned product, we’ll process your refund within 10 business days.
  • Refunds will be issued to your original payment method.

Consumer protection rights

Nothing in this refund policy limits or excludes any statutory rights under your local consumer protection laws:

  • Australia. Under Australian Consumer Law, you’re entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage. These rights cannot be excluded.
  • New Zealand. Under the Consumer Guarantees Act 1993, goods must be of acceptable quality, fit for purpose, and match their description.
  • Canada. Provincial consumer protection legislation may provide additional rights.
  • Singapore. The Consumer Protection (Fair Trading) Act provides protections against unfair practices.
  • Indonesia. Consumer Protection Law No. 8 of 1999 provides additional rights regarding product quality and safety.

If your local laws provide more generous rights than those set out above, those laws will prevail.

07Warranty

1-year limited warranty

Cool Bionic provides a 1-year limited warranty on all products from the date of original purchase. Covers defects in materials and workmanship under normal use.

What is covered

  • Manufacturing defects in materials or workmanship.
  • Mechanical or electrical component failures occurring under normal use.
  • Structural integrity issues arising during the warranty period.

What is not covered

  • Damage from misuse, abuse, neglect, or failure to follow instructions and safety guidelines.
  • Damage from unauthorised modification, repair, or alteration.
  • Normal wear and tear, including cosmetic damage such as scratches and dents.
  • Damage from improper installation, including failure to use a licensed electrician where required.
  • Damage from improper water treatment, poor water chemistry, or neglected filter maintenance.
  • Damage from environmental factors — extreme weather, flooding, improper storage.
  • Damage from non-approved accessories or chemicals.
  • Products purchased from unauthorised resellers.

Warranty service process

  • Step 1 — Remote diagnosis. Contact support@coolbionic.com. We first attempt to diagnose and resolve remotely — troubleshooting guidance, video calls, or replacement parts sent to you.
  • Step 2 — Local service. If not resolvable remotely, we arrange local repair service in your area at our expense, where available.
  • Step 3 — Return for repair. If neither remote nor local service works, we’ll provide a shipping address and cover shipping both ways for repair.

We aim to complete warranty repairs within 14–30 business days from receipt, depending on the issue and parts availability.

Statutory warranty rights

This warranty is in addition to, and does not affect, your statutory rights under applicable consumer protection laws. In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. In New Zealand, the Consumer Guarantees Act 1993 provides additional protections.

08User Accounts

When you create an account, you’re responsible for:

  • Providing accurate and complete registration information.
  • Maintaining confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorised use.

We reserve the right to suspend or terminate accounts we reasonably believe are being used fraudulently, in violation of these Terms, or for any unlawful purpose. We’ll provide notice and an opportunity to respond, unless immediate action is necessary to prevent harm.

09Intellectual Property

All content on the Cool Bionic website — text, graphics, logos, images, product designs, software, and trademarks — is the property of Cool Bionic Limited or its licensors, protected by applicable intellectual property laws in Hong Kong and internationally.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent, except for personal, non-commercial use such as downloading product information for your own reference.

10Prohibited Uses

You agree not to use our website or services to:

  • Purchase products for resale without written authorisation.
  • Provide false, misleading, or fraudulent information.
  • Interfere with or disrupt the operation of our website or servers.
  • Attempt unauthorised access to any part of our website or systems.
  • Use automated tools (bots, scrapers) to access or collect data from our website.
  • Engage in activity that violates applicable laws or regulations.

We reserve the right to refuse service, cancel orders, and terminate accounts of customers who violate these prohibitions.

11Health & Safety

Please Read Carefully

This section contains critical health and safety information regarding the use of our cold plunge and ice bath products.

General health warning

Cold water immersion carries inherent health risks, including hypothermia, cardiac arrest, respiratory failure, loss of consciousness, and drowning. By purchasing and using our products, you acknowledge these risks and accept full responsibility for your use.

Our products are not medical devices. They are not designed, intended, or marketed to diagnose, treat, cure, or prevent any disease. Any claims regarding health benefits of cold water immersion are general wellness information, not medical advice.

Medical clearance required

Consult a qualified medical professional before using any Cool Bionic product, particularly if you have:

  • Cardiovascular conditions. Heart disease, arrhythmias, history of heart attack or stroke, uncontrolled or high blood pressure.
  • Circulatory conditions. Raynaud’s phenomenon, peripheral vascular disease, poor circulation.
  • Respiratory conditions. Asthma, COPD, or other chronic respiratory conditions.
  • Pregnancy. Cold water immersion is not recommended during pregnancy.
  • Diabetes or neuropathy. Conditions affecting temperature sensation or circulation.
  • Cold sensitivity. Cold urticaria, cryoglobulinemia, or cold allergy.
  • Medications. Beta blockers, blood thinners, or medications affecting heart rate, blood pressure, or circulation.
  • Any other serious medical condition. If unsure, consult your physician before use.

We strongly recommend obtaining written medical clearance before your first use and whenever your health status changes.

Safe use guidelines — temperature & duration

  • Water temperature must remain at or above 2.7°C (37°F). Never use water below this temperature.
  • Recommended range: 10°C–15°C (50°F–59°F).
  • First-time users should limit sessions to no more than 1 minute.
  • Experienced users should not exceed 10 minutes per session.
  • Never exceed 15 minutes under any circumstances.
  • Always check water temperature with a reliable thermometer before use.

Usage precautions

  • Never use alone. Always have another responsible adult present.
  • Never use under the influence of alcohol, drugs, sedatives, or when drowsy.
  • Enter feet-first and slowly. Never jump or dive in.
  • Do not hyperventilate before or during immersion.
  • Do not attempt breath holds while in the ice bath.

Exit immediately if you experience

  • Chest pain or tightness
  • Difficulty breathing or breathlessness
  • Numbness or loss of sensation
  • Skin pallor or blue discolouration
  • Confusion, disorientation, or dizziness
  • Uncontrollable shivering

After use

  • Do not go directly into a hot shower or sauna — this can cause a dangerous drop in blood pressure.
  • Allow your body to rewarm gradually.
  • Do not consume alcohol before or immediately after use.

Age restrictions

Our products are intended for adults aged 18 and over. Persons under 18 may only use our products if they have written medical approval and are under constant adult supervision. Access by children and pets must be prevented when the product is not in use — the cover must be secured at all times when unattended.

Electrical safety

If your product includes electrical components (chiller, heater, pump):

  • Professional installation required. All electrical connections must be installed by a licensed electrician per local codes.
  • Use a dedicated circuit with appropriate amperage per product manual.
  • GFCI protection. A Ground Fault Circuit Interrupter outlet is mandatory for any outlet within 2 metres (6 feet) of the product.
  • All connections must be watertight. Maintain minimum clearances per manual.
  • Never operate electrical components in standing water or during electrical storms.
  • Regularly inspect electrical connections and cords for damage. Do not use if damaged.

Water treatment and hygiene

You are fully responsible for maintaining proper water hygiene:

  • Maintain water pH between 7.2 and 7.6.
  • Use appropriate sanitiser (pool-grade chlorine, bromine, or hydrogen peroxide) per manual.
  • Test water chemistry regularly (at minimum, before each use).
  • Clean and replace filters per maintenance schedule.
  • Shower before each use to minimise contamination.
  • Drain and replace water regularly per manual.

Failure to maintain proper water chemistry may void your warranty and may create health hazards including bacterial growth and skin infections.

Installation and property

You are responsible for ensuring that:

  • The installation location can support the weight of the product when filled and occupied.
  • Adequate drainage is available to prevent water damage.
  • The product is installed on a level, stable surface.
  • All local building codes and regulations are complied with.

Cool Bionic is not liable for property damage resulting from water leaks, condensation, freezing, improper drainage, inadequate structural support, or improper installation.

No performance guarantees

Cool Bionic makes no express or implied guarantees regarding specific health outcomes — athletic recovery, performance enhancement, weight loss, pain reduction, improved sleep, mental health benefits, or any other claimed benefit of cold water immersion. Individual results vary and depend on numerous factors beyond our control.

12Limitation of Liability

General limitation

To the maximum extent permitted by applicable law, Cool Bionic, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

  • Loss of profits, revenue, or business opportunities.
  • Loss of data or goodwill.
  • Personal injury or death arising from misuse or failure to follow safety guidelines.
  • Property damage resulting from improper installation, maintenance, or use.
  • Emotional distress or loss of enjoyment.

Our total aggregate liability for any claim shall not exceed the total amount you paid to Cool Bionic for the specific product giving rise to the claim.

Exceptions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our proven negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded under mandatory consumer protection laws of your jurisdiction (including the Australian Consumer Law, the NZ Consumer Guarantees Act 1993, and equivalent legislation elsewhere).
Australian Customers

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

13Indemnification

You agree to indemnify, defend, and hold harmless Cool Bionic, its directors, officers, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms.
  • Your misuse of our products, including failure to follow safety guidelines and warnings.
  • Your violation of any applicable law or regulation.
  • Any third-party claim arising from your use of our products.

This obligation survives the termination of these Terms and your use of our products.

14Force Majeure

Cool Bionic shall not be liable for any delay or failure arising from circumstances beyond our reasonable control — natural disasters, pandemics, government actions (including changes in tariffs, sanctions, or import/export restrictions), war, terrorism, labour disputes, supply chain disruptions, transportation failures, or interruptions in utilities or communications.

We’ll make reasonable efforts to notify you promptly and resume performance as soon as practicable. If the delay exceeds 60 days, either party may cancel the affected order for a full refund.

15Governing Law

Governing law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Dispute resolution

  • Step 1 — Informal resolution. Contact support@coolbionic.com and attempt to resolve informally for at least 30 days.
  • Step 2 — Mediation. If unresolved, either party may refer the dispute to mediation administered by the Hong Kong International Arbitration Centre (HKIAC).
  • Step 3 — Arbitration. If mediation fails, the dispute shall be referred to and finally resolved by arbitration administered by the HKIAC under its administered arbitration rules. Seat: Hong Kong. Language: English. Single arbitrator.

Local consumer rights

Nothing in this section limits your right to bring legal proceedings in the courts of your country of residence if required by mandatory local consumer protection laws:

  • Australia. You may bring proceedings in Australian courts under the Australian Consumer Law.
  • New Zealand. You may bring proceedings before the Disputes Tribunal or NZ courts under the Consumer Guarantees Act.
  • Canada. Provincial consumer protection legislation may grant you the right to bring proceedings in your province.
  • Singapore. You may bring claims before the Small Claims Tribunals for eligible disputes.
  • Indonesia. Consumer disputes may be resolved through the Consumer Dispute Settlement Body (BPSK).

16Modifications

We reserve the right to update or modify these Terms at any time. When we make material changes:

  • We’ll update the effective date at the top of this document.
  • We’ll provide notice through our website or by email for significant changes.
  • Continued use after such changes constitutes acceptance of the updated Terms.

For existing orders, the Terms in effect at the time of your purchase continue to apply.

17Severability

If any provision is found invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed. The remaining provisions continue in full force and effect.

18Entire Agreement

These Terms, together with our Privacy Policy and Shipping Policy, constitute the entire agreement between you and Cool Bionic regarding your use of our website and purchase of our products, and supersede all prior or contemporaneous agreements, communications, or representations.
